The jury requested to rewatch cellphone video and hear legal definitions of recklessness and negligence. The trial began in October and focused on whether Penny caused the man’s death and whether his actions were justified. Prosecutors claim Penny held the man in a chokehold for too long, while Penny’s attorneys argue he was trying to protect himself and others. The victim, Jordan Neely, had schizophrenia and started yelling threats on the subway before Penny restrained him. The trial will continue on Friday morning as the jury works to reach a verdict.
