President-elect Donald Trump has once again received a legal win as his sentencing for a May criminal conviction has been delayed indefinitely. This marks the third time sentencing has been pushed back, with a judge ruling to give Trump’s lawyers until December 2 to file a motion seeking to dismiss the case outright. Trump was found guilty for his role in a coverup of a “hush money” payment, but has yet to learn his fate due to these delays.
Prosecutors have expressed they do not oppose delaying sentencing, even until after Trump’s presidency, but will fight any effort to dismiss the case. Trump’s attorneys argue that the conviction should be set aside and the case dismissed because he was elected president, labeling the case unconstitutional to move forward with.
In May, a jury convicted Trump on 34 felonies related to a scheme to hide reimbursements to his former lawyer, Michael Cohen, for a payment made to adult film star Stormy Daniels. The payment, often referred to as “hush money,” was to silence Daniels about an alleged sexual encounter with Trump before the 2016 election. Despite the conviction, Trump maintains his innocence, denying the falsifying of business records charge he was found guilty of.
This latest delay in sentencing comes as Trump continues with his transition plans, with key players in his legal team working to navigate this ongoing legal battle amidst his presidential aspirations.
