Supreme Court upholds Biden administration’s power plant emissions rule


The Supreme Court has rejected an emergency request to halt the Biden administration’s plan to reduce emissions from coal-fired power plants, despite having blocked a similar plan under the Obama administration. Justices Brett Kavanaugh and Neil Gorsuch believe the challengers may ultimately win some arguments, but there is no immediate urgency for the court to intervene. The rules were announced by the EPA in April to combat climate change, with challenges arguing that the technology required is unworkable and the EPA exceeded its authority. This action is reminiscent of the previous attempt to reduce carbon emissions under the Obama administration, which was blocked by the Supreme Court in 2016, leading to its repeal by the Trump administration. The current rules would require existing coal and new natural gas power plants to cut or capture 90% of their greenhouse gas emissions by 2032. The EPA argues that this reduction is achievable through carbon capture technology, while opponents question the feasibility and readiness of this technology. The EPA estimates that most coal power plants will likely close by 2045, with some already planning retirement. While some power companies have challenged the EPA, others have supported the rule, such as Pacific Gas and Electric Company and Con Edison. The D.C. Circuit Court of Appeals has declined to pause the rules, citing that compliance efforts do not need to begin until next year.
