The family of Gregory Delpeche, a bystander shot in the head by police at a Brooklyn subway station last month, has filed an $80 million legal claim against the city. Delpeche, who is currently confined to a hospital bed with severe injuries, is seeking compensation for his medical costs and suffering. His lawyer, Nick Liakas, stated that while no amount of money can fully make up for the harm Delpeche has endured, they hope to provide him with the resources necessary to take care of his medical needs.
The shooting occurred when police attempted to subdue a suspect, Derell Mickles, who allegedly entered the station without paying the fare. Despite attempting to use a Taser, the situation escalated and gunfire ensued, resulting in multiple injuries including Delpeche being shot in the head. Mickles pleaded not guilty to charges related to the incident.
Delpeche, who has suffered severe cognitive deficits as a result of the shooting, had part of his skull removed to relieve swelling in his brain. His family is calling for major policy changes, including eliminating the use of Tasers on civilians, in order to prevent similar incidents in the future.
The city law department has declined to comment on the legal claim. The Delpeche family’s pursuit of accountability and policy changes reflects a broader concern over the NYPD’s use of force and de-escalation tactics.
