DA drops charges against migrant initially accused in gang attack on NYPD officers after being ‘exonerated’

The Manhattan District Attorney’s Office has dropped all charges against Jhoan Boada, a migrant who was initially accused of participating in the beating of two New York City police officers in Times Square. The charges were dropped after prosecutors determined that another individual, Marcelino Estee, was the one responsible for the assault. Boada infamously flipped off reporters after being released without bail, sparking criticism of Manhattan DA Alvin Bragg.

Following the attack, several suspects were arrested but later released without bail, leading to public outrage. However, some of the suspects have since been rearrested and are being held. One of the assaulted officers, NYPD Lieutenant Ben Kurian, will be attending President Biden’s State of the Union address as a guest of U.S. Rep. Nicole Malliotakis. The attack highlighted the challenges faced by law enforcement officers in dealing with violent crimes committed by individuals in the country illegally.

Malliotakis has called for an end to the Biden Administration’s border policies that have allowed unvetted individuals to enter the country illegally. She invited Lt. Kurian to the State of the Union to show support for law enforcement and raise awareness of the issue. The dropping of charges against Boada and the ongoing legal proceedings against the other suspects underscore the complexities surrounding immigration and law enforcement in New York City.
